Proposed ban on visas for parents, siblings angers expats

KUWAIT: Kuwait''s immigration authorities are mulling over the prospect of banning expatriate workers in the country from applying for visit visas for their parents as well as their bloodـrelated siblings. This has caused many expatriates working in Kuwait to ponder over how much their presence is wanted in Kuwait. Many expats see themselves as an integral part of this society whereby they have come to feel that Kuwait is their home. While talking to Al Watan Daily, many expats expressed appreciation to Kuwait, a country that has allowed them to make a decent living. However, some are having second thoughts about staying on here and although the proposed ban on parents and siblings has not been implemented as yet, expats feel that this is an act that strips them of their human rights.

Labeed Abdal, attorney at law, Constitutional expert, and Head of the International Committee at the Kuwait Bar Association said this announcement was released form the office of the Director General of Immigration and it was considered an administrative decision and not a law issued from the Parliament and could be changed and amended easily.
"Those decisions are considered to be temporary to regulate some matters in society, in this case it was said that it is related to reducing the numbers of old exـpatriots to provide better medical services," he explained.
Furthermore, the expert pointed out that medical care can be reformed by having better hospitals, more qualified doctors'' better pay for health consultants and advanced nursing teams. "Developing medical care and promoting the health system in Kuwait is not the responsibility of the Ministry of Interior and actually is part of the main obligations of the Health Ministry which has a specialized minister who will be questioned in the Parliament if the medical care in Kuwait for the Kuwaitis or the nonـKuwaitis becomes worse," the legal expert explained.

Kuwaiti lawyer Abdal extols ‘employee-friendly’ labor law

KUWAIT CITY, Feb 18: A Kuwaiti lawyer on Wednesday extolled the draft of the new labor law and termed it: “employee-friendly.” Speaking to the Arab Times, Labeed Abdal went on to add that the new law has included provisions for labor unions, extra paid vacations and allowances following pregnancy, minimum wage etc. It may be recalled that the Health, Social and Labor Affairs Committee in the Parliament is currently studying 25 amendments to the new Labor Law which is expected to be forwarded to the National Assembly before March 3. The committee is also expected to expedite procedures to finalize the law in time for the parliamentary session which is slated for the second reading of the law.

Replying to a question whether he was expecting the proposed law to be passed anytime soon, he expressed hope that the government would adopt the law as soon as possible, even as he said that the recommendations put forward by the International Labor Organization should also be taken into consideration. He said the International Labour Organization has impressed upon the need to have labor unions for foreign workers, cancellation of the sponsors system, besides providing protection for working women.

Exploitation
Replying to another question whether the new law will be able to put an end to the exploitation of workers at the hands of unscrupulous employers, Abdal went on to say that the matter in question can be resolved by forming labour unions and that the embassies should also play an active role in defending the rights of the workers. Furthermore, the embassies should also coordinate with the concerned government agencies to ensure that any harassment or maltreatment cases involving their nationals should be dealt with swiftly, he added. He also added that there is also need to prosecute recruitment agencies which dupe the workers, even as these companies hire workers and fail to provide them proper jobs, thereby leaving them high and dry.Abdal expressed hope that the proposed law will be able to tide over the problems faced by menial workers and that the image of Kuwait will receive a boost on the international front.

The proposed law stipulates the following:
1) It makes the worker recruitment process transparent.
2) Prevents women from working in the night.
3) Employees cannot work more than 48 hours on a weekly basis.
4) Employers should provide proper accommodation for their employees.
He added that the draft law has come under flak because it made new restrictions on women working at night, as the new law prevents women from working from 8 pm until 7 am, even as hospitals are an exception.

Restricts
Abdal noted that he has an issue with only one clause of the draft law “that restricts the working hours of women.” Taking the point further, he said: “Banning women from working in the night is totally an unfair decision as I feel that they are being denied their rights. If the law is passed, then many women will lose jobs and this is something they can ill-afford to do in these recessionary times,” he added. “Traditionally, the restriction was related to some restaurants and cafes in some of the areas in Kuwait because the owners of those places depended on some women workers in late hours to attract customers. There were a few incidents of abuse and harassment against women and these issues were reported by the media.” “I, for one, believe that there is no need to prevent women from working at night, as there are many professions that entail late working in professions such as doctors, lawyers, journalists etc. “

''Segregating between women, men against human values''

KUWAIT: There have been recent debates about the new Labor Law that is expected to go into motion soon. One aspect of the law, which 43 MPs voted in favour of during its first session, will prevent women working between the hours of 10 p.m. till 7 a.m. Many experts and individuals are questioning this law and challenging it, arguing that such a law goes against basic human rights. This topic is a contentious one and is seen by many as a setـback to women rights in Kuwait. Imposing this law will be difficult and unfeasible, argued many experts.
Labeed Abdal, attorney at law, Constitutional expert, and Head of the International Committee at the Kuwait Bar Association, said that the new draft law was a result of the Parliament, which still included some members who were "against women''s rights and the prevention from working at night, was related to some cases against some clubs and cafes depended in their services on ladies at night. However, this restriction was not realistic, especially when there are many female doctors or journalists and other women professionals that need to do their job in any time of the day."
The expert went on to explain reactions about the new amendments related to the draft law. "So far, the new draft has received criticism from the local unions, women''s societies and above all the International Labor Organization (ILO), especially on the areas of canceling the sponsorship system, protecting the low paid and house workers, unions for foreign workers and the need to allow group cases."
In regard to women workers, the law was criticized because it imposed new restrictions on women working at night, where the new law prevented women from working from 10 p.m. till 7 a.m. excluding hospitals.
"This restriction historically, was related to some restaurants, entertainment clubs and shisha cafes, where they depended on some women workers in late hours to attract customers and there were few incidents of women abuse and harassment that took place and was brought to the local/international media and the Parliament discussions," Abdal explained.
He further said the matter could be organized by administrative measures to regulate those shops and oblige them to make necessary changes; for example, requesting the commercial license to provide the needed security and protection for women workers during the night. And providing safe transportation and to make sure that work in that area of business came after the consent of the worker.
"There is no need to prevent women from working at night in general as there are many professions that requires women to work during the night. These jobs include the professions of: doctors, lawyers, journalists, etc. Any generalization in that case is considered against the principles of equality which were mentioned in the constitution of Kuwait and can be considered as sexual discrimination between men and women which were prevented by the international conventions of civil and human rights and Kuwait has already signed," the lawyer pointed out.
Abdal added that the new draft came closer to the ILO requirements to protect the working women''s rights. Moreover, it added some benefits which were not previously mentioned especially the benefits and holidays after pregnancy that would elevate equality in the workplace. The new law included some new changes, after the old law which was issued in 1964. The new law was approved in the first debate in the Parliament and will be reـdiscussed by the Parliament in the coming session.
"The new law has some new benefits, like improving the minimum wage, fighting visa traders, and providing more benefits to the working women after pregnancy," he added however.
"The new Labor Law was long been awaited by labor unions and even from expatriates, especially the minimum wage issue, and we can say that it amended 70 percent of the old law which was released in 1964."

النظام العالمي الجديد

استطاع الشعب الاميركي بحق، وقبل نهاية العقد الاول من القرن الواحد والعشرين، انهاء احدى بقايا التمييز العنصري بسبب اللون، واختيار اول رجل من اصول افريقية في البيت الابيض.
وعلى الرغم من أن هذا التغيير جاء نتيجة دور الشعب الاميركي واختياراته في الداخل، فانه يجب ان لا تُنسى التغيرات العالمية الحتمية المصاحبة والمتزامنة حول العالم، بشأن الاقتصاد وأزمته المتفاقمة، والدور الاميركي الذي طالما كان مؤثرا.
لا شك ان التغيير المذكور في الولايات المتحدة سيكون مرتبطا، بصورة او باخرى، بما يحصل في العالم، خصوصاً مع تساقط النظم المالية بصورة مترابطة، كأثر للعولمة الاقتصادية التي عُمل من اجل وجودها عبر القرن الماضي، والتي لم تنفصل كذلك عن الحرب الباردة، وانهاء الصراع بين القطبين القديمين، وقيادة العالم بقطب واحد.
هذه المعادلات تتعرض الآن للاهتزازات، وهي بحاجة إلى اعداد مسبق على اعتبار ان التغيرات تصيب مراكز قوى عالمية، بكل تبعاتها واتباعها.
الديون الضخمة في الولايات المتحدة واوروبا، والتحديات الصينية التي لها صدى كبير في ميزان القوى الحالي، ومدى امكان ظهور نظام عالمي جديد، تبرز معها على السطح تساؤلات مهمة بشأن مدى استمرار اللاعبين الكبار انفسهم، واحتمالات ظهور لاعبين جدد، خصوصاً في مساحات التنافس الاقتصادي والسياسي.
ان اعتبار الدول المتأثرة اقتصاديا اسواقا سابقة للصين، وفقدان دورها الاقتصادي المحتمل لمزيد من الترويج للانتاج الصيني، واعتبار الدول المتقدمة سببا لتطور ماكينة الانتاج الصيني ووصولها الى ما وصلت اليه، إن هذه الاعتبارات تدل على الحاجة المزمنة الآن إلى مزيد من الحلول التوافقية لا التنافسية، واعادة حشد القوى، من اجل اعادة بناء وترميم شروخ كبيرة في حوائط الاقتصادات والسياسات العالمية، التي ستؤثر وتتأثر حتما في مضامير اخذ القرارات الدولية، وساحات الامن والسلام العالميين.

هل ستشهد نهاية؟

لا يمكن عزل القضية الفلسطينية عن تاريخ المنطقة، والعديد من الاحداث ولغة المصالح السائدة عند بدء الاحداث المتزامنة معها.
اذ بالرجوع الى رسالة ثيودور هرتزل الى السلطان عبدالحميد، يتضح قدم نوايا اليهود في شأن فلسطين، ومحاولات استمرار اقراض الدولة العثمانية، مقابل الموافقة على تشجيع الهجرة الى فلسطين، وتحقيق دولة لهم، وذلك قبل سقوط الدولة العثمانية، التي غرقت بالديون والفساد.
اما بعد زوال الدولة العثمانية وانعدام سيطرتها على الاقاليم العربية، فقد تم استعجال اللجوء الى اتفاقية سايكس ـ بيكو 1916، التي قامت على تقسيم الاقاليم العربية بين فرنسا وبريطانيا بالتنسيق مع روسيا، كامبراطوريات قائمة ومسيطرة في ذلك الوقت، وانشاء نظام الانتداب، ثم ألحق هذا الامر بوعد بلفور، الذي جاء كرسالة من وزير الخارجية البريطاني آرثر جيمز بلفور عام 1917، لزعيم المجتمع البريطاني اليهودي المدعو اللورد ليونيل ولتر روتشيلد، بانشاء وطن قومي لليهود على ارض فلسطين.
وفي العام نفسه، صدر صك الانتداب على فلسطين من قبل عصبة الامم، وتعيين حكومة صاحبة الجلالة لادارة الاقليم، وانشاء وطن قومي لليهود في فلسطين.
هذه الوقائع التاريخية توحي بأن القضية الفلسطينية، قد جاءت من منظور القوى المنتصرة التي صنعت كيانا جديدا على الخارطة، بعد سقوط الدولة العثمانية، وبصورة توحي عبر ما سيقترب من القرن من الزمان، بأنها جاءت لكي لا تنتهي، ولتحقق الوعود لليهود على تلك الارض من جانب، ومن جانب آخر كان الامر وسيلة لنقل أتباع الديانة اليهودية الى دولة لهم خارج اوروبا، وبالتالي وقف الصراع الديني والطائفي في اوروبا.
باجمال ذلك، وبتتبع احداث تلك القضية، فإنه يبرز اخلال واضح بشأن حق الشعوب في تقرير المصير، الذي نصت عليه الفقرة الثانية من المادة الاولى من ميثاق الامم المتحدة 1945، والمادة الاولى من العهدين الدوليين لحقوق الانسان لسنة 1966، حيث ظل الشعب الفلسطيني مهددا، وظلت هنالك دول واشخاص ومنظمات مستفيدون من هذا التعطيل العبثي، سواء لاستمرار الدول المحيطة بفلسطين في الحصول على المساعدات الدولية، او لاستمرار الصراعات وصور الاحتراب المتكرر، واستنزاف ميزانيات المنطقة، خصوصا امام تلك المعادلة غير العادلة، التي تلقى دعما دوليا غير عادي وشبه دهري.
ونجد انه قد آن اوان محاولة التعديل، في اطار موازين جديدة، خصوصا مع الازمة الاقتصادية الخانقة بمواجهة العالم الذي خلق تلك الوعود، والانتدابات، والوصايات، بمواجهة من نظر اليهم في حينه، كناقصي الأهلية وعديمي التمييز، ونقول انه قد آن الاوان لاعادة النظر، وان هذه الامم التي كانت مغلوبة على امرها اذ ذاك، قد حققت الآن الكثير على ارض الواقع، وتحمل رغبة انسانية حقيقية بالعيش المشترك مع الآخر، وبالمساهمة الفاعلة الحرة في آمال البناء والتنمية والاستقرار العالمي، على اسس من النضج والرغبة بالشراكة الدولية، وفق قواعد من الحرية والمساواة، وليس الخضوع او الخنوع الذي كانت له بداية، ولا بد ان تشهد له نهاية.
